CANCELLATION POLICY

If you need to cancel a session both Therapist/Tutor are required to give 24hrs notice. Clients are also required to provide 24hrs notice. If the client misses a session without cancellation the session will be lost.

We comply with the GDPR in the UK and EU.

Our host and server is certified under the EU-US Privacy Shield Framework and the Swiss-US privacy Shield Framework as set forth by the U.S. Department of Commerce, regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States, and therefore adheres to the Privacy Shield Principles.

CLIENTS

If you engage us for consultancy we keep anon records that you send us on a secure central server. We delete these records after 6 months and do not archive them. 

SESSION RECORDING

No party has permission to record the online session without prior written consent from SEN WORLD and SEN World professionals.

If the professional wishes to record session - formal written consent must be sought via SEN WORLD & Client

NO MOBILES

Professionals are banned from sharing their mobile numbers with clients. Clients should inform SEN WORLD if a professional requests their mobile number. This is safeguarding measure. 

No exchanges can take place on social media or messenging apps.

All engagements must take place on TEAMS/ZOOM or SKYPE

Service Level Agreement - United Kingdom (with Limitation of Liability)

This Service Level Agreement ("Agreement") is entered into by and between SEN WORLD LTD ("Contractor") and [Client name] ("Client") as of the [Effective Date].

1. Purpose and Scope

The purpose of this Agreement is to define the service level targets and obligations for the Contractor in providing qualified and professional therapists to the Client on a regular basis to meet the Client's operational needs.

2. Service Level Targets

(a) The Contractor will use its reasonable endeavours to provide the Client with therapists at the agreed times and dates.
(b) The Contractor will provide the Client with the number of therapists and hours as stated in the Service Contract.
(c) The Contractor will ensure that all therapists provided meet the required qualifications and experience as specified in the Service Contract.
(d) The Contractor will ensure that all therapists adhere to the Code of Ethics and Professional Conduct of the regulatory bodies which govern their profession.
(e) The Contractor will ensure that all therapists have undergone the necessary Disclosure and Barring Service (DBS) checks for Speech and Language & Occupational Health clearance requirements before attending any work on Client premises.
(f) The Contractor will ensure that all therapists are of good appearance and conduct themselves in a professional and appropriate manner while performing their duties.

3. Responsibilities of the Contractor

The Contractor agrees to the following:

(a) The Contractor will ensure that all therapists are registered with the appropriate regulatory bodies and maintain valid insurance.
(b) The Contractor will ensure that all therapists receiving work through the company are fully trained to provide the required level of service for the Client.
(c) The Contractor will work with the Client to ensure there is adequate notice when arranging therapist cover and implement a contingency plan if any therapist fails to attend.
(d) The Contractor will keep accurate records of all therapists provided to the Client, including details of any absence and replacements.

4. Responsibilities of the Client

The Client agrees to the following:

(a) The Client will provide the Contractor with complete and accurate information regarding the required therapists, including dates, times, and required qualifications, on a regular basis.
(b) The Client will ensure that all therapists have access to a suitable and safe workspace while on Client premises.
(c) The Client agrees to provide a minimum of 2 notice before any anticipated interruption to services or downtime takes place.

5. Termination

Either party may terminate this Agreement at any time with written notice to the other party, without prejudice to any rights or liabilities accruing prior to the date of termination.

6. Confidentiality

The parties will keep all information shared or received during the contract term confidential under the provisions of the Data Protection Act.

7. Limitation of Liability

The Client agrees that the Contractor shall have no liability for any injury, death, loss, damage or expense arising from the provision of the therapists, except to the extent caused by the negligence of the Contractor or their staff.

8. Governing Law and Jurisdiction

This Agreement shall be governed by and interpreted in accordance with the laws of England and the courts of England shall have exclusive jurisdiction over any dispute arising out of or in connection with this Agreement.

9. Entire Agreement

This Agreement constitutes the full and final understanding of the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this Agreement.

10. Amendments

This Agreement may not be amended or modified except in writing signed by both parties.

By commissioning services the parties agree to the terms of this Service Level Agreement, including the Limitation of Liability clause.

Invoicing 

Invoice Late Charges Statement - UK

  1. Late Payment Charges: If the purchase invoice is not paid according to the agreed payment terms or is paid after the due date, a Late Payment Charge will be applied at a rate of 8% over the Bank of England Base Rate on the outstanding balance. The Late Payment Charge will be calculated from the day after the payment due date to the date of payment.

  2. Suspension of Services: If payment is not made within 10 days after the payment due date, the Company may at its discretion suspend or terminate the services until full payment is received.

  3. Invoice Rate : Smaller services commissioned across an Academic Year may be billed in one Invoice as opposed to separate invoices.

  4. Additional Costs: The Company will also be entitled to recover all reasonable costs incurred in pursuing any overdue payment, including legal fees and debt recovery costs.

  5. Right to Charge Interest: The right to charge late payment interest is governed by the Late Payment of Commercial Debts (Interest) Act 1998, which sets the statutory interest rate for late payment at 8% above the Bank of England Base Rate. Please note that this rate is subject to change by the Bank of England from time to time, and the latest rate can be found at the Bank of England website.

  6. Notification: In case of non-payment or late payment, the Company may send notices or reminders to the customer, unless the customer has disputed the invoice in good faith.

  7. Disputed Invoices: In case of disputed invoices, the customer shall notify the Company within 3 days of receipt of the invoice, providing reasons for the dispute. Payment of the undisputed portion of the invoice shall be due within the agreed payment terms, while the disputed portion will be resolved in accordance with the dispute resolution provisions set out in the contract between the parties.

By accepting the goods or services or by signing below, the customer agrees to the payment terms, including the Late Payment Charges set out above.
